Collin County Judge Clears Dak Prescott of Civil Claims Related to Sexual Assault Allegations

Months after Dallas police decided not to move forward with any charges, a Collin County judge has now cleared Dak Prescott of all civil claims related to the sexual assault allegations made against him. These allegations date back to 2017, when Prescott was accused of sexual assault by an individual who initially sought $100 million in exchange for not pursuing the matter with law enforcement.

In March, the accuser filed a report with the Dallas Police Department, renewing the spotlight on the case. Prescott, maintaining his innocence, filed both a civil lawsuit and a criminal report against the accuser. By April, the legal chess game intensified as the accuser’s attorney dropped a Dallas County lawsuit only to file a similar one in Collin County.

Legal Developments

Judge Angela Tucker dismissed the accuser’s claims in June. The Dallas Police Department also concluded there was insufficient evidence to support the allegations against Prescott. Levi G. McCathern, Prescott's attorney, was adamant about his client's innocence, stating, "As we knew they would, they found nothing in their extensive exploration of the facts that would support a criminal prosecution."

In addition to defending against the accusations, Prescott has taken an offensive stance, filing a civil lawsuit seeking over $1 million, citing extortion. The accuser’s attorney further complicated matters by sending a letter in January suggesting she would drop the pursuit of criminal charges in return for the $100 million originally demanded. This led McCathern to declare that "the original lies by [the accuser], her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak."

Ongoing Legal Battles

The legal skirmish is far from over. Despite the judge's dismissal of the civil claims, Prescott’s lawsuit alleging extortion and the accuser's parallel lawsuits continue to dangle precariously in Collin County civil court. The accuser’s motion for a "non-suit without prejudice" leaves the door open for her to refile the case in Dallas County.

A hearing scheduled for September will determine if further legal action against the accuser is necessary. McCathern expressed confidence in Prescott's case, remarking, "We are confident that at the end of law enforcement's investigation into the extortion case that they will find the accuser and her attorneys just as guilty as Dak is innocent."

Impact On Prescott

Prescott, meanwhile, remains focused as he enters the final season of a four-year, $160 million contract in 2024. Despite the whirlwind of legal battles, he emphasized his clarity on the matter: "I know the truth, I'm confident in what we filed, very confident in what we filed."

The allegations have cast a shadow over a successful career, but Prescott's team is resolute in clearing his name. "Mr. Prescott -- a new father to a baby girl -- has great empathy for survivors of sexual assault," McCathern noted. "These ploys distract from the trauma of legitimate sexual assault survivors and undermine the progress that our society has made in supporting them."

Final Thoughts

It remains to be seen how the pending litigation will unfold, but for now, Prescott stands legally vindicated. "To be clear, Mr. Prescott has never engaged in any nonconsensual, sexual conduct with anyone. Lies hurt. Especially, malicious lies. We will not allow the Defendant and her legal team to profit from this attempt to extort millions from Mr. Prescott," McCathern concluded.

The upcoming hearing and continuing court battles underscore the complexity and emotional toll of the situation. However, Prescott's legal team remains firmly committed to ensuring that justice prevails both in clearing his name and holding the accuser accountable for what they allege is an elaborate extortion scheme.
